Software License

NOTE: The License Agreement for this software may change from time to time, for example, when new versions of the software are released. In this event, when you download a new version of the software, the latest License Agreement will be displayed at the start of the installation procedure, and you will be given the option to accept the License Agreement. If you elect not to accept the License Agreement, you will not be able to install the new version of the software.

LICENSE AGREEMENT

You should carefully read the following terms and conditions before using this software. Your use of this software indicates your acceptance of this License Agreement and warranty.

The Screen Movie Recorder component of Advanced Multimedia Extension: Part of this product is derived from RenderSoft CamStudio.

DEFINITIONS

The following definitions shall apply in this document:

"ANSWERS 2000": Answers 2000 Limited, 16 Willow Chase, Hazlemere, High Wycombe, HP15 7QP, United Kingdom.

"Advanced Multimedia Extension for Activ E-Book Compiler": this software package, used for adding Multimedia capabilities to E-Books, property of ANSWERS 2000.

"AMM" - Abbreviation for "Advanced Multimedia Extension for Activ E-Book Compiler"

"USER": You - any who has purchased a license to use "AMM".

"READER": a person using E-Books created by USERs.

DISTRIBUTION

1. This software may not be distributed by any party other than Answers 2000 Limited.

2. No component part of Activ E-Book Compiler may be distributed individually, disassembled, copied, reverse engineered, or altered in any form.  The sole exception to this term is item 3:

3. E-Books created using this software, and in accordance with the documentation, include runtime components built-in to the E-Book, and USERs are fully authorize to distribute such E-Books.

4. This product includes a number of MIDI files intended for the USER to use in E-Books (including free or for-sale E-Books) that they create with our software. The MIDI files included with this package are Copyright (C) 2003, Answers 2000 Limited. We grant USERs a royalty-free license to distribute these files as part of their E-Books, provided they comply with all of the following conditions:
(i) The MIDI files may only be used in conjunction with E-Books created with the registered version of Activ E-Book Compiler.
(ii) The MIDI files must be included in the source folder of the USER's E-Book at the time that it is compiled, and not distributed in any external folder/directory etc.
(iii) The MIDI files may not be altered in any way.
(iv) The USER must not encourage or facilitate any person's/entity's usage, reproduction or distribution these MIDI files, except for listening to them as part of the USER's E-Book.
(v) The USER must include a clear and prominent notice in their E-Book in the following words: "Music in this E-Book is Copyright (C) 2003, Answers 2000 Limited and used under License. Unauthorized reproduction, distribution or performance of this music is strictly prohibited. Answers 2000 Limited has not necessarily read nor endorse nor agree with the content of this E-Book. All content within the E-Book is the sole responsibility of the author.".
 The only acceptable variations are:
 (A) To use the words "Some music" instead of "Music" in the case where the USER's E-Book also includes music which is not covered by our Copyright,
 and/or (B) To use the word "software" or "package" or "product" instead of "E-Book" at the USER's discretion,
 and/or (C) To use the word "authors" instead of "author" where more than one author created the E-Book,
 and/or (D) USER may omit "Answers 2000 Limited has not necessarily read nor endorse nor agree with the content of this E-Book. All content within the E-Book is the sole responsibility of the author." only if USER makes it absolutely clear that Answers 2000 Limited has not read, reviewed or endorsed the USER's E-Book.

5. This product does not include any "codecs" (software for compressing/encoding to, or decompressing/decoding from) multimedia formats. However this software is designed function with third party (from Microsoft or other third parties) codecs which interface with Microsoft Windows. The USER is solely responsible for ensuring their use of any such codecs and multimedia file formats is in accordance with any applicable licenses, laws or regulations.

"DIRECT" USE ONLY

1. The license is granted to USER only. The USER may not install the software in any form of environment which allows other parties access to the software, for example via remote- or web-based access, whether for free or in return for any form of consideration.  This includes, but is not limited to, providing remote access over a network, over the Internet, or a web-site.

NO LIABILITY, NO WARRANTIES

1. In no event will ANSWERS 2000 be liable to any party for any direct, indirect, punitive, special, incidental or other consequential damages arising directly or indirectly from any use of Activ E-Book Compiler, or E-Books created using the Activ E-Book Compiler, even if ANSWERS 2000 is expressly advised of the possibility of such damages.

2. This software is provided "as is" and without warranties as to performance of, merchantability or any other warranties whether expressed or implied. The USER assumes the entire risk of using this software, and distributing any E-Books created using this software.

3. In all cases, READERs are the USER's customers, and are not customers of ANSWERS 2000.

4. Even if these limitations are found not to apply, the maximum liability of ANSWERS 2000 will be limited to replacement of this software product or refund of the purchase paid to ANSWERS 2000 by the USER, according to ANSWERS 2000's preference.

PRODUCT SUPPORT

1. No formal product support is provided, but USERs are encouraged to send questions, comments or suggestions to ANSWERS 2000 by e-mail or by writing.

COMMENT

1. Any comments or materials sent to ANSWERS 2000 regarding the ANSWERS 2000's web sites, Activ E-Book Compiler or any of the ANSWERS 2000's products or services may be used by ANSWERS 2000 without liability, and without compensation or attribution to the sender. ANSWERS 2000 may reproduce, use, disclose, exhibit, display, transform, create derivative works and distribute such content or materials to others without limitation.

LINKS TO OTHER WEB SITES

1. Information on ANSWERS 2000's web sites, Activ E-Book Compiler, or in E-Books created using Activ E-Book Compiler may contain links or references to other sites. Other sites may contain links or references to ANSWERS 2000's web sites, products or services. ANSWERS 2000 does not endorse, and is not responsible for, any product or service offered by any entity other than itself.

UNSOLICITED E-MAIL AND MESSAGING

1. USER agrees not to use any form of unsolicited e-mail or unsolicited messaging, to promote E-Books created using Activ E-Book Compiler or web/FTP sites containing/linking to such E-Books.

2. USER agrees not to make any reference to Activ E-Book Compiler, ANSWERS 2000, or any of ANSWERS 2000's products or services, in any form of unsolicited e-mail or unsolicited messaging.

INTERNET NEWSGROUPS (USENET)

1. USER agrees not to use inappropriate, or off-topic, postings to Internet newsgroups (Usenet) to promote E-Books created using Activ E-Book Compiler or web/FTP sites containing/linking to such E-Books.

2. USER agrees not to make inappropriate, or off-topic, postings to Internet newsgroups (Usenet) make any reference to Activ E-Book Compiler, ANSWERS 2000, or any of ANSWERS 2000's product or services in any form of unsolicited e-mail or unsolicited messaging.

3. A Usenet news article shall be considered inappropriate if does not fully comply with the written charter/FAQ of the newsgroup to which it is posted. The USER is responsible for determining the rules of a newsgroup before posting to it.

4. Established Usenet conventions ("Netiquette") prohibit advertising in most Usenet newsgroups. USER may post advertisements only in those newsgroups that specifically permit them in the charter or FAQ. Some newsgroups may permit "classified ads" for single transactions between private individuals, but not commercial advertisements. USER is responsible for determining whether or not a newsgroup permits advertisements before posting.

GOVERNING LAW

1. This agreement shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from matters relating to this agreement and/or this product and/or Activ E-Book Compiler shall be exclusively subject to the jurisdiction of the courts of England and Wales. You agree that any legal action against Answers 2000 Limited (or its directors, officers, or employees) relating to this agreement and/or this product and/or Activ E-Book Compiler will be brought in the courts of London, England, however the Company reserves right to pursue breach of these terms in any jurisdiction.
